California man fights against age discrimination

When you've been working for a company for a number of years, the last thing you want to have to worry about is age discrimination. Age discrimination could result in your being let go only due to your age, even though you have more experience than others. Or, you may not be able to get hired. In this case, a man is claiming that the school district he worked for in La Mesa, California, passed him over for a promotion due to his age and retaliation.

The Jan. 20 report claims that the man, a 61-year-old, filed a lawsuit in July 2012 against two top supervisors and the district. In it he says he applied for the job of skilled maintenance worker eight times, with four of those happening since 2007. He says he's been a skilled maintenance worker at the school for 26 years. He claims that over the time he's worked there, he's seen a number of people be promoted, and all but one were younger than he was and had less time on the job.

The school district, however, is claiming that there are legitimate and nondiscriminatory reasons for the man not getting the promotion. They also disagree with the lawsuit because they claim he never pursued his complaints through an administrate process, which is spelled out in his contract. The man disagrees with the school; he thinks this is all retaliation because he had filed a Cal-OSHA complaint in 2011 for being forced to work in and around asbestos and lead paint. He was not trained to do so.
