According to reports, actress Sharon Stone has been accused of violating another employee’s rights. Stone was sued earlier this week by a former employee who claims that she was fired after she suffered an injury that had prevented her from doing her work as quickly as she normally performed her work duties prior to being injured. The actress was sued last year by a nanny who claimed that Stone fired her after Stone realized the nanny was being paid for overtime hours worked.
Stone claims that the nanny’s allegations are not true. The actress has not yet commented on the lawsuit that was filed against her earlier this week in Los Angeles County Superior Court. The lawsuit has been filed by a former maid for the actress who was fired last summer. The lawsuit claims that in addition to firing the employee under illegal circumstances, Stone also violated the employee’s rights by failing to provide the injured worker with reasonable accommodations in the workplace.
The Americans with Disabilities Act and the California Fair Employment and Housing Act provide employees with specific workplace protections when they become injured, ill or are disabled. One of the protections includes requiring employers to make reasonable accommodations for workers so that workers can continue to perform their essential duties while they are recovering from an illness, injury or disability. Even though workers may be restricted from performing certain tasks at work, employers must make accommodations so that their employees can continue to work if they are able to do so. Failing to provide accommodations when employers are obligated to do so is a violation of employees’ rights.
The former maid who is suing Stone claims that she was injured in June 2012 while she was carrying groceries for the actress. The maid’s doctor advised her not to lift heavy objects for a certain period of time and to also take some time off of work to recover from her injury. However, the maid claims that Stone forced her to return to work against the doctor’s orders. When the woman returned to work, Stone failed to provide the worker with reasonable accommodations and still required the worker to lift heavy objects even though the maid was not supposed to until she recovered from her injury.
The maid claims that Stone fired her for not performing her duties quickly enough even though the worker was injured and in pain.
