According to Jan. 8 reports, the Lakeport City Council has rejected a claim from the former city attorney. The claim stated that he believed he was wrongfully discharged and that the city was in breach of contract. Now, the council has rejected the claim, stating that the 56-year-old man who served as the city’s attorney for 30 years was fired for reasons that can’t be disclosed to the public.
According to the news, around 2.5 years before he was fired, the attorney had been arrested for a DUI and hit and run with property damage. However, this case was settled as a misdemeanor DUI. The man did face a public reproval by the State Bar in Jan. 2012. The 56-year-old attorney claims that he was removed from his appointment because the most recent contract would have provided him with a 2.5 percent retirement package at age 55 under the California Public Employees’ Retirement System. However, if he was let go before Dec. 31, 2013, he would only receive six months of compensation and accrued sick leave, worth substantially less. He wouldn’t receive six months of pay if he was terminated for a few different reasons, like dishonesty, misconduct, or other problems. He claims he didn’t receive the six months of pay he believed he had the right to.
It’s not difficult to imagine getting let go from a job early to prevent the company from having to pay out for retirement or other benefits.
