Employers cannot discriminate on the basis of gender

California employees should understand there is no place for discrimination in any type of workplace. Regardless of the type of job you have, you should never experience discrimination or negative treatment on the basis of your gender. If you are experiencing this treatment, you have the right to take action.

In many cases, victims of sex discrimination are women. Unfortunately, women may face negative treatment simply because of gender, even if it has no bearing on their physical and mental abilities to do their jobs. If you suffered discriminatory treatment in your workplace, there are laws in place that protect you, and you can fight back.

Understanding your rights

You have the right to a workplace that is free from discrimination and harassment of all kinds. Unequal treatment on the basis of sex is not necessarily treatment that is different, but it is treatment that is unfair. Some examples of gender discrimination against women in the workplace include:

  • Failure to hire a qualified candidate because of gender
  • Paying women less than men for the same work
  • Withholding certain privileges granted to male employees
  • Depriving female employees of opportunities for advancement

One of the most common types of gender discrimination faced by female employees in the workplace is sexual harassment. Employers are not only responsible for not allowing  hostile work environments and harassment against women, they must take steps to remedy any type of inappropriate situation reported to them.

If you believe you are being intentionally left out, mistreated, paid less or subjected to sexual harassment simply because you are female, there are both state and federal laws in place that protect you. Those laws can enable you to seek justice and compensation  through a civil claim.

The right action against gender discrimination

Many people feel unsure of their rights or how they can fight back against gender discrimination in the workplace, but you do not have to suffer alone. If you are unsure if you have a case or fear retaliation from your employer, you should seek legal advice.

This step will enable you to learn about your legal rights, and provide you with a better understanding of your legal options. Illegal gender discrimination in the workplace is simply unacceptable, and you can hold your employer accountable for what you suffered.
